i dont know who the previous owner is

I cant contact the previous owner about the apple id password or email. therefore I cannot setup my device.

There isn't a way to bypass activation lock without the assistance of the previous owner. If you purchased it through a 3rd party (e.g., eBay) contact them to see if they will refund.
